It is certainly possible to define an unorthodox sense of victim foreseeability under which hidden victims such as Bessie and Baldwin do count as foreseeable. For the Palsgraf principle is not, at bottom, about victim foreseeability (or plaintiff foreseeability) at all. Rather, the principle maintains that a plaintiff must be wronged — must be treated carelessly or otherwise wrongfully by the defendant — in order to recover. Plaintiff unforeseeability is simply one sort of factor that precludes a defendant from treating the plaintiff carelessly, from breaching a duty to be careful toward her.
